Prosecutor Warns of Recent Phone Scams

Morris County Prosecutor Fredric M. Knapp announces advises residents that at least one individual has been victimized in an apparent telephone scam.  Recently, a resident of East Hanover received a phone call in which the caller identification appeared to be coming from the Internal Revenue Service.  The caller stated that the resident owed money for back taxes.  The victim was instructed to obtain “re-load it cards” and provide the perpetrator with access to the card and the money loaded onto the card.  The victim subsequently received a second call in which the caller identification appeared to be coming from the Morris County Sheriff’s Office.  The caller identified himself as a police officer with the Morris County Prosecutor’s Office.  The resident was informed that unless additional money was paid, a Sheriff’s Officer would come to his home to arrest him.  The resident was instructed to obtain cashier’s checks for a substantial amount of money.

Prosecutor Knapp warns all residents that neither the Prosecutor’s Office, the Sheriff’s Department nor the Internal Revenue Service would ever demand or request money over the telephone.  No matter how persistent or convincing the caller may appear, residents are advised not to provide money, access to accounts or obtain debit cards which can be accessed by the caller.

Borough of Wharton Armed Robbery

Morris County Prosecutor Fredric Knapp and Borough of Wharton Police Chief Anthony Fernandez announce an active investigation into an armed robbery that occurred on February 19, 2015 in the Borough of Wharton, New Jersey.

On February 19, 2015, at approximately 7:46 p.m.., a report of an armed robbery was made involving an incident that occurred at the Delta Gas Station, located at 217 South Main Street in the Borough of Wharton.   

Initial reports indicated that two males entered the Delta Gas Station, and one of the males brandished a firearm and demanded money from the gas station employee.  The two individuals ultimately fled the scene on foot.

Arrests Made in Hanover Township Shooting Investigation

Morris County Prosecutor Fredric Knapp and Hanover Township Police Chief Stephen W. Gallagher announce the arrest of Daniel J. Wendt, twenty-three (23) years old of Boonton, New Jersey, on charges related to a shooting that occurred on February 20, 2015 at the Econo Lodge located at 1255 State Route 10 East, Whippany, New Jersey. 

On February 20, 2015, at approximately 3:30 p.m., law enforcement officers were dispatched to the Econo Lodge on a report of a shooting.  The victim, whose identity is being withheld at this time, suffered a gunshot wound and was transported to a local hospital to be treated.

On February 21, 2015, Daniel Wendt was charged with various crimes related to this incident.  He has been charged with one count of Attempted Murder, one count of Possession of a Weapon for an Unlawful Purpose, and one count of Unlawful Possession of a Weapon. 

During the early morning hours of February 22, 2015, Daniel Wendt was arrested in Brooklyn, New York, as a fugitive from justice.  Daniel Wendt was taken into custody by members of the Major Crimes Unit of the Morris County Prosecutor’s Office, the Hanover Township Police Department, with the assistance of the New York Police Department.    

Also arrested at that time was Amelia M. Valentin, age twenty-four (24) of Paterson, New Jersey.  Amelia Valentin has been charged with Endangering the Welfare of a Child and Hindering Apprehension, both of which are related to this on-going investigation. 

Both Daniel Wendt and Amelia Valentin will be held in the custody of the New York authorities pending extradition proceedings. 

Numerous law enforcement agencies took part in this investigation, including the Major Crimes Unit of the Morris County Prosecutor’s Office, the Hanover Township Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, and the New York Police Department.

Prosecutor Knapp and Chief Gallagher wish to thank the Hanover Township Police Department, the New York City Police Department, and the Major Crimes Unit of the Morris County Prosecutor’s Office for the swift and safe apprehension of these subjects.  “Assistant Prosecutor Sahil Kabse worked tirelessly with  Detectives with the Major Crimes Unit and the Hanover Police Department, who were led by Lt. Mark Roddy, Lt. Robert McNally and Sgt. Steven Brylinski to solve this case and swiftly bring this dangerous defendant to justice.”  

The charges and allegations are merely accusations, and the defendants are considered innocent unless and until proven guilty.

KASHIF PARVAIZ FOUND GUILTY OF MURDER OF WIFE IN 2011 KILLING

Morris County Prosecutor Fredric M. Knapp announces the return of a guilty verdict in the murder trial of Kashif Parvaiz, age thirty (30).  Earlier this morning, the jury returned a verdict of guilty against Kashif Parvaiz on counts of Murder (a crime of the first degree), Conspiracy to Commit Murder (a crime of the first degree), two counts of Possession of a Weapon for an Unlawful Purpose (crimes of the second degree), two counts of Unlawful Possession of a Weapon (crimes of the second degree), Prohibited Weapons and Devices (a crime of the fourth degree), Endangering the Welfare of a Child (a crime of the second degree), and Hindering One’s Apprehension (a crime of the third degree). 

 This prosecution stemmed from the arrest of Kashif Parvaiz for his role in the shooting death of his wife, Nazish Noorani, on Cedar Street in the Town of Boonton on the night of August 16, 2011.    

Supervising Assistant Prosecutor Matthew Troiano and Assistant Prosecutor Erin Callahan represented the State during the prosecution of this matter.

This matter is scheduled for sentencing before the Honorable Robert J. Gilson, J.S.C. on April 24, 2015. 

Prosecutor Knapp stated: “Nothing will ever restore Nazish to her family.  As her two young children grow up, they will never have their mother by their side.  Her family, and most especially her siblings, will never see her again.  This verdict, however, demonstrates to all of her loved ones that justice has been served.”

West Morris Mendham HS Teacher Indicted

Morris County Prosecutor Fredric M. Knapp and Chief Pasquale Libertino of the Mendham Borough Police Department announce the indictment of 32 year-old Nicole McDonough aka Nicole L. Howell, of Mount Olive Township, New Jersey, on three counts of Official Misconduct, a crime of the second degree.

 

Law enforcement received information that the defendant allegedly engagedin improper relationships with male students while she was employed as a teacher at West Morris Mendham High School. An investigation ensued which revealed that defendant had relationships with three 18 year-old male students. These relationships allegedly consisted of improper communication and impermissible fraternization, and included a physical sexual relationship with one of the three students. The relationship with one student allegedly occurred in April, May, and June of 2013, and the relationships with the other two students allegedly occurred in April, May, and June of 2014.

 

McDonough was initially arrested on December 30, 2014, following an investigation conducted by the Morris County Prosecutor’s Office Sex Crimes/Child Endangerment Unit and the Mendham Borough Police Department. The investigation was led by Detective Bruce LaFera of the Morris County Prosecutor’s Office and Detective Chris Irons of the Mendham Borough Police Department.

ARRESTS MADE IN JEFFERSON TOWNSHIP BANK ROBBERY

Morris County Prosecutor Fredric Knapp and Jefferson Township Police Chief Kevin Craig announce the arrest of William Chasmer (age 57) of Oak Ridge, New Jersey and Janet C. Kaine (age 44) of Oak Ridge, New Jersey, on charges related to a Robbery that occurred on March 11, 2015 at the PNC Bank located on Berkshire Valley Road in Jefferson Township New Jersey. 

 Both William Chasmer and Janet Kaine were charged with one count of Robbery, a crime of the first degree, and one count of Conspiracy to Commit Robbery, a crime of the second degree. Chasmer’s bail was set at $250,000, full cash, bond or property without a ten percent option. Kaine’s bail was set at $150,000, full cash, bond or property without a ten percent option.  Both defendants were remanded to the Morris County Correctional Facility.

 At approximately 9:40 a.m., on March 11, 2015, a report of a bank robbery was made involving a description of an armed male entering the bank branch and demanding money. 

 The investigation led law enforcement to William Chasmer’s residence where he was arrested without incident.  Further investigation developed Janet C. Kaine as an alleged accomplice.

 Numerous law enforcement agencies responded to investigate, including the Major Crimes Unit of the Morris County Prosecutor's Office, the Jefferson Township Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, and the FBI. 

The charges and allegations are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

Morris County Prosecutor's Office Drug Investigation Dismantles Inter-State Marijuana Distribution & Money Laundering Network

Morris County Prosecutor Fredric M. Knapp announces the arrest of several high level marijuana traffickers following a several month long drug investigation into the head of east coast operations. Arrested are Salman “Tito” Khalid (age 25) of Wharton Borough, New Jersey, James E. Matthews (age 50) of Indianapolis, Indiana, and Kernley Saint-Victor (age 25) of Clifton, New Jersey.



Members of the Morris County Prosecutor’s Office, Special Enforcement Unit, received information from numerous individuals regarding a multi-state marijuana distribution network locally controlled by Salman “Tito” Khalid (age 25) of Wharton Borough, New Jersey. An investigation was commenced by members of the Morris County Prosecutor’s Office, Special Enforcement Unit and Task Force Officers assigned to the Unit.

Intelligence developed during the investigation revealed that Salman Khalid was receiving significant quantities of marijuana weekly in Morris County, New Jersey. Further information established that the bulk quantities of marijuana received by Salman Khalid were being provided to lower level dealers to be distributed throughout the area. Information was also developed that Khalid was going to receive a delivery of marijuana on March 3, 2015.

On March 3, 2015, an individual later identified as James E. Matthews (age 50) of Indianapolis, Indiana was observed operating a Ford F-350 with an attached trailer. Matthews, with the assistance of Khalid, were observed by law enforcement unloading several large cardboard boxes at Khalid’s residence. Police conducted a motor vehicle stop of Matthews at the direction of the Morris County Prosecutor’s Office. After K-9 patrol alerted to the presence of a Controlled Dangerous Substance within the vehicle and trailer, a search warrant was obtained. Matthews was released by law enforcement at the scene pending the search warrant application.

After a search warrant was approved, law enforcement officials located and seized roughly 360 pounds of marijuana from the interior of the vehicle and trailer. This bulk seizure has an estimated retail street value of over $1 million dollars. In addition, approximately $124,000.00 in U.S. currency was also located during the search. The marijuana and money were contained in vacuum sealed pouches located within several large cardboard boxes, duffle bags and storage bins. Police also located a large quantity of marijuana “wax” which is an extremely dangerous and potent derivative of marijuana that contains high concentrations of THC (Tetrahydrocannabinol).



It was later determined that Matthews fled the area after he was released from the scene of the motor vehicle stop. He was located in Indianapolis, Indiana on March 5, 2015 and was arrested by the Indianapolis Police Department. Found in his possession was $73,000.00 in U.S. currency. Matthews was taken into custody and has been charged with first-degree Possession with the Intent to Distribute a Controlled Dangerous Substance, second-degree Conspiracy to Possess with the Intent to Distribute a Controlled Dangerous Substance, second-degree Financial Facilitation of Criminal Activity (Money Laundering), and fourth-degree Possession of a Controlled Dangerous Substance. Matthews is currently lodged in an Indianapolis jail awaiting extradition to Morris County, New Jersey.

Police searched the Wharton residence controlled by Khalid and the vehicle of one of Khalid’s customers, Kernley Saint-Victor (age 25 of Clifton, NJ). These searches revealed multiple pounds of marijuana and an additional $9,000 dollars in cash, both of which were seized.

Salman “Tito” Khalid was charged with second-degree Conspiracy to Possess with the Intent to Distribute a Controlled Dangerous Substance, second-degree Possession of a Controlled Dangerous Substance with the Intent to Distribute, third-degree Financial Facilitation of Criminal Activity and fourth-degree Possession of a Controlled Dangerous Substance. Khalid is currently lodged in the Morris County Correctional Facility with a $200,000.00 bail as well as a no bail Intensive Supervision Program (ISP) Detainer out of Hudson County, New Jersey for a prior Distribution of a Controlled Dangerous Substance conviction.

Also arrested was Kernley Saint-Victor (age 25) of Clifton, New Jersey. Saint-Victor was charged with second-degree Conspiracy to Possess with the Intent to Distribute a Controlled Dangerous Substance, third-degree Possession of a Controlled Dangerous Substance with the Intent to Distribute, and fourth-degree Possession of Marijuana. Saint-Victor is currently lodged in the Morris County Correctional Facility with a $200,000.00 bail.

The Honorable Stuart A. Minkowitz, P.J.Cr. authorized the warrant complaints and bails for all defendants.

All cash seized and three (3) vehicles and trailer are all subject to civil forfeiture.

Prosecutor Knapp stated: “The coordinated efforts of numerous law enforcement agencies dismantled a sophisticated multi-state drug distribution and money laundering network that was importing hundreds of pounds of narcotics into Morris County. I would like to thank each Chief of Police and our Federal Law Enforcement partners that committed manpower to this investigation. Law Enforcement agencies working together in a taskforce are an invaluable resource that is necessary to combat well-financed organized criminal networks.”

BODY FOUND IN PASSAIC RIVER IDENTIFIED

Morris County Prosecutor Fredric M. Knapp and Long Hill Township Police Chief Michael Mazzeo report that the body found in the Passaic River on March 18, 2015, has been positively identified as David Bird (age 55 when reported missing) who has been the subject of an ongoing missing person investigation.

 Dr. Carlos A Fonsecaof the Morris County Medical Examiner’s Office, and forensic ondotologist Mitchell M. Kirshbaum, DDS have positively identified the body found as that of David Bird. Identification was made through dental records.  At this time, the Medical Examiner’s investigation into the cause and manner of death is ongoing.    

On Wednesday, March 18, 2015, at approximately 5:00 pm two (2) men canoeing in the Passaic River came across a red jacket located near branches. They immediately notified Bernards Township Police Department. Police later determined the existence of human remains and a multi-agency recovery operation commenced to include members of the Morris County Prosecutor’s Office, the Long Hill Township Police Department, the Bernards Township Police Department, the Liberty Corner Fire Department, Millington Fire Department, the Parsippany Search Rescue and Recovery Team, the Morris County Sheriff’s Office, the Morris County Park Police, Berkeley Heights Fire Department, Whippany Fire Department, Boonton Township Fire Department, Morris County Fire Coordinator, Denville Dive Team, Liberty Corner First Aid Squad. The following agencies supplied boats for the recovery: Whippany Fire Department, Millington Fire Department and Berkeley Heights Fire Department.

 The search for David Bird began on Saturday, January 11, 2014, when he was last seen leaving his home on Long Hill Road, in the Millington section of Long Hill Township, New Jersey, to take a walk.

The Long Hill Township Police Department had been the lead agency in this missing person investigation with assistance from the Morris County Prosecutor’s Office.

MAN PLEADS GUILTY TO 2013 MOTOR VEHICLE CRASH THAT KILLED THREE IN JEFFERSON TOWNSHIP

Morris County Prosecutor Fredric M. Knapp announces that Defendant Luis E. Torres, age 39, of Jersey City, New Jersey, pled guilty today in Morris County Superior Court before the Honorable Robert J. Gilson, J.S.C. to charges stemming from a drunk driving motor vehicle crash that occurred on August 24, 2013 in Jefferson Township, which left three occupants of his vehicle dead.

The Defendant pled guilty to one count of Aggravated Manslaughter, in violation of N.J.S.A.2C:11-4a(1), a crime of the first degree, Two counts of Vehicular Homicide, in violation of N.J.S.A. 2C:11-5a, crimes of the second degree, four counts of Assault by Auto, in violation of N.J.S.A. 2C:12-1c(1), crimes of the fourth degree, one count of Assault by Auto, in violation of N.J.S.A.2C:12-1c(2), a crime of the third degree and Driving While Intoxicated. Under the terms of the plea agreement, the State will seek a sentence of twenty (20) years in New Jersey State Prison with an 85% period of parole ineligibility pursuant to the No Early Release Act.   

On August 24, 2013, defendant and his family were traveling on Route 15 South in Jefferson Township, New Jersey. The defendant was operating a 2002 Ford Explorer when it flipped over.  There were nine occupants inside the vehicle including the defendant. Three of the occupants were children under the age of 18. Several passengers were ejected from the vehicle resulting in the deaths of three passengers. The defendant and five remaining passengers suffered injuries.  The decedents are Lucila Colon, age 62; Julissa Colon, age 36; and Tevia Booth, age 11. 

Sentencing in this matter is scheduled for May 29, 2015 before the Honorable James DeMarzo, J.S.C.

UPDATE ON FATALITY AS A RESULT OF A MOTOR VEHICLE ACCIDENT AT ALSTEDE FARMS IN CHESTER TOWNSHIP

Morris County Prosecutor Fredric M. Knapp and Chester Township Police Chief Wayne Martini announce the conclusion of the criminal investigation into the October 2014 motor vehicle accident that resulted in the death of a minor child at the Alstede Farms in Chester, New Jersey.     

On October 12, 2014, law enforcement was dispatched to Alstede Farms located at 1 Alstede Farms Lane, Chester New Jersey on a report of pedestrians struck by a vehicle.  A minor child and two adults were struck and injured by a shuttle bus.  The minor child ultimately succumbed to her injuries. 

The investigation revealed that a 2006 Chevrolet van, color white (Vehicle #1), as well as a second van, color black (Vehicle #2), were shuttling passengers to and from stops between the Gladstone Train Station and Alstede Farms.  At the time of this incident, Vehicle #2 was parked in a driveway of 94 Rt. 24 and was loading passengers.  Vehicle #1 was positioned behind Vehicle #2.  The minor child, her mother, and friend, were positioned between Vehicle #2 and Vehicle #1 when Vehicle #1 rolled forward causing the fatal injuries to the minor child, and the injuries to the other parties. 

After a thorough investigation by law enforcement, and in coordination with the Morris County Medical Examiner’s Office, and Drug Scan, a private toxicology company, no evidence of criminal conduct was found on the part of the driver of the vehicle.  As such, no criminal charges are forthcoming arising out of this incident.

BUDD LAKE MAN FOUND GUILTY OF RESISTING ARREST

Morris County Prosecutor Fredric M. Knapp announces that a Morris County Jury found         Jaime H. Fernandez (age 32) of the Budd Lake section of Mt. Olive Township, New Jersey  guilty of one count of third degree Resisting Arrest 2C:29-2A(3)(A). The jury returned its verdict after 1 day of deliberation. The Honorable Salem V. Ahto, J.S.C presided over the two (2) day trial.

 

Assistant Prosecutor Stephen Bollenbach, assigned to the General Investigations Unit of the Morris County Prosecutor’s Office, represented the State during the trial.  

 

This matter is scheduled for sentencing before the Honorable Salem V. Ahto, J.S.C. on April 30, 2015.

 

This prosecution stemmed from the arrest of Mr. Fernandez in January 2014 by two officers of the Mt. Olive Township Police Department.  Mr. Fernandez became combative with the officers when they tried to serve him with court documents.

 

Prosecutor Knapp would like to thank Chief Mark Spitzer and the officers of the Mt. Olive Township Police Department as well as the Morris County Prosecutor’s Office General Investigations Unit whose efforts contributed to this result.

Prosecutor Knapp Announces Ceremony to Commemorate National Crime Victims’ Rights Week

Morris County Prosecutor Fredric M. Knapp announces that the Morris County Prosecutor’s Office will recognize 2015 National Crime Victims’ Rights Week (April 19-25) with a Recognition and Remembrance Ceremony. The ceremony, honoring victims and advocates of victims’ rights, will take place on Wednesday, April 22, 2015 at 11:00 a.m. in the Freeholder’s Public Meeting Room, 5th Floor, in the County Administration and Records Building on Court Street in Morristown, New Jersey.


This year the Morris County Prosecutor’s Office is honored to have as its Keynote Speaker for the ceremony, Maria Vinci-Savettiere, Esq., Executive Director of the Deirdre O'Brien ChildAdvocacy Center (Deirdre’s House), a nationally accredited Child Advocacy Center (CAC) located in Morristown, New Jersey. The Center was named for the daughter of Jim and Georgia O’Brien. Jim O’Brien was a former Morris County Freeholder who served on the Board of Trustees of Deirdre's House and was Chairman of the Victims of Crime Compensation Board.


The Honored Guest this year will be Chief James Simonetti of the Roxbury Township Police Department.  Chief Simonetti is the President of the Morris County Police Chiefs Association.


National Crime Victims’ Rights Week has been a time of national remembrance since 1981. It is an opportunity for communities, victims and their loved ones, and professionals serving victims to join together and reflect on the progress achieved in victims’ rights. The theme for the 2015 National Crime Victims’ Rights Week is “Engaging Communities. Empowering Victims.” This theme emphasizes the role of the entire community, individually and collectively, to support victims of crime and empower them to direct their own recovery.


Thirty years ago, crime victims did not have rights, access to crime victim compensation, or services to help rebuild their lives. They were often excluded from courtrooms, treated as an afterthought by the criminal justice system, and denied an opportunity to speak at sentencing. Today, all states have enacted crime victims’ rights laws and established crime victims’ compensation funds.

 

Prosecutor Knapp is proud of the outstanding team of capable and dedicated professionals in the Morris County Prosecutor’s Office who assist victims of crime and advocate on their behalf.

Roxbury Township Board of Education Lead Mechanic Charged and Sentenced to Theft Charge

Morris County Prosecutor Fredric M. Knapp and Chief James Simonetti of the Roxbury Township  Police Department announce that Matthew Hofgesang, age 47, of Kenvil, New Jersey was charged with one count of Theft (N.J.S.A. 2C:20-3(a)), a Disorderly Persons Offense.  

 

An investigation revealed that Hofgesang, lead mechanic for the Roxbury Township Board of Education, used the override key to obtain gasoline and diesel fuel without the permission or the authority of the Board of Education. The theft of fuel occurred on diverse dates between June 1, 2014 and March 7, 2015. During the course of the investigation, both visual and video surveillance captured the defendant obtaining fuel.  

 

Hofgesang admitted that he stole fuel and estimated the total to be approximately 1900 gallons. He also admitted using the override key to obtain the fuel, then used the fuel for personal use as well as sold some of the fuel to third partiesfor his personal gain. Hofgesang confirmed that he knew hedid not have permission or authority to take the fuel. 

 

The Honorable Stuart A, Minkowitz, P.J.Cr. sentenced Hofgesang today to one (1) year probation, restitution in the amount of  $8,150.00 payable to the Roxbury Township Board of Education. He also ordered that the defendant forfeit his public employment in the State of New Jersey.

 

The State is represented by Morris County Prosecutor’s Office Senior Trial Counsel John McNamara in this matter.  Detective Daniel Haber of the Morris County Prosecutor’s Office Professional Standards Unit along with Detective William Manisaof the Roxbury Township Police Department handled the investigation.

Montville Man Arrested for Kidnapping

Morris County Prosecutor Fredric M. Knapp and Montville Township Police Chief Rudolf Appelmann announce that Christopher T. Conzola, age 38, of Montville, New Jersey, has been charged with Kidnapping, a crime of the first degree in violation of N.J.S.A. 2C:13-1a and/or 2C:13-1b(2); Aggravated Assault, a crime of the third degree in violation of N.J.S.A. 2C:12-1b(2); Possession of a Weapon for an Unlawful Purpose, a crime of the third degree in violation of N.J.S.A.2C:39-4d; Unlawful Possession of a Weapon, a crime of the fourth degree in violation of N.J.S.A. 2C:39-5d; Terroristic Threats, a crime of the third degree in violation of N.J.S.A. 2C:12-3, and Resisting Arrest, a crime of the third degree in violation of N.J.S.A. 2C:29-2.

 

During the early morning hours of April 14, 2015, Conzola and an adult female victim were in his home located on Eugene Drive in Montville, New Jersey when policeofficers from the Montville Police Department received a 9-1-1 call regarding a man holding a hostage at knife point. 

 

Upon their initial response to this location, law enforcement officers were able to make contact with Conzola.  That communication was then terminated.  Ultimately, law enforcement officers from the Morris County Sheriff’s Emergency Response Team (S.E.R.T) were able to make entry into the home and arrest Conzola, during which time Conzola physically resisted law enforcement officers’ efforts to detain him.  During this altercation, one law enforcement officer received minor injuries. 

 

The adult female victim, who was held in the home by Conzola, was taken to a nearby hospital for treatment and ultimately released.

 

The Honorable Stuart A. Minkowitz, P.J.Cr. set a cash only bail of $400,000 with additional conditions.  The Defendant will be remanded to the Morris County Correctional Facility.

Man Charged with Murder of Three Year Old

Morris County Prosecutor Fredric M. Knapp and Montville Township Police Chief Rudolf Appelmann announce that Maurice Pearson, age 26, with a last known address of 55A Route 46 East, Pine Brook, New Jersey, and formerly of Altoona, Pennsylvania, has been charged with first degree Murder for the beating death of his girlfriend’s three year old son. Additional charges filed today consist of Possession of a Weapon for an Unlawful Purpose, and Unlawful Possession of a Weapon were also authorized.

On April 10, 2015, at approximately 1:16pm, officers with the Fairfield Township Police Department responded to the Knights Inn, located at 55A Route 46 in Pine Brook, New Jersey (Montville Township) on a report of a male choking.

As a result of the investigation into this incident, Maurice Pearson was originally charged with Aggravated Assault and Endangering the Welfare of a Child, both second degree crimes, for physically abusing the three year old child. Pearson was also charged with one count of Aggravated Assault, a third degree crime, for physically assaulting his girlfriend (age 25). Pearson was also charged with an additional count of Hindering His Own Apprehension, a crime of the third degree, for providing false information to law enforcement during the course of this investigation.  Pearson was remanded to the Morris County Correctional Facility in lieu of a $100,000 bail.

At the time of the assault, the child and his mother were taken to a nearby hospital for treatment. The child’s mother was treated and released.  However, the child sustained more serious injuries as a result of the assault and remained hospitalized until succumbing to his injuries on April 13, 2015.

On April 16, 2015, the Honorable William J. McGovern III, J.S.C., authorized charges against Pearson for Murder, a crime of the first degree, Possession of a Weapon for an Unlawful Purpose, a crime of the third degree, and Unlawful Possession of a Weapon, a crime of the fourth degree.  Bail was set at $1,000,000 cash, bond or property.  Pearson remains in custody at the Morris County Correctional Facility.

Members of the Montville Police Department, Morris County Prosecutor’s Office Major Crimes Unit and Sex Crimes/Child Endangerment Unit, the Morris County Sheriff’s Office - Criminal Investigation Section, and the Fairfield Police Department have contributed to this investigation.

The investigation is active and ongoing.  No other information is being released at this time.

Former Paterson School Teacher Pleads Guilty to Official Misconduct and Criminal Sexual Contact

Morris County Prosecutor Fredric M. Knapp and Chief Paul Phillips of the Parsippany Troy-Hills Police Department announce that Scott A. Van Hoven, 48, currently of Hudson, N.Y., and formerly of Parsippany, N.J., pled guilty today to one count of Official Misconduct, a crime of the second degree, and two counts of Criminal Sexual Contact, crimes of the fourth degree. 

 

Van Hoven was a music teacher at John F. Kennedy High School in Paterson, N.J., when he engaged in various sexual acts with a 16 year-old female who was a student at the school.  The acts occurred in both Paterson and Parsippany, New Jersey.

 

Defendant faces a sentence of seven (7) years New Jersey State Prison, subject to a five (5) year term of parole ineligibility.  In addition, defendant is subject to registration pursuant to Megan’s Law, will forfeit his New Jersey teaching certificates and will be prohibited from seeking future public employment. 

 

The Honorable Salem Vincent Ahto, J.S.C. (Retired, Temporarily Assigned on Recall) presided over the plea. The sentencing is scheduled for May 27, 2015.

County Prosecutors Association of the State of New Jersey Announces Scholarships

The County Prosecutors Association of New Jersey announces the availability of the Oscar W. Rittenhouse, Andrew K. Ruotolo, Jr., Harris Y. Cotton and the John H. Stamler Memorial Scholarships. The County Prosecutors Association of the State of New Jersey Committee, a nonprofit corporation, annually awards scholarships to law students, college and graduate students.  Each scholarship is a one-year grant in the amount of up to $3,500.00 paid directly to the recipient.  Scholarship recipients from previous years are ineligible.

 

To be eligible for the Oscar W. Rittenhouse Memorial Scholarship, an applicant must be a New Jersey resident accepted for admission to a law school.  The applicant must have an interest in pursuing a career as a prosecutor.  The applicant must also demonstrate financial need.

 

To be eligible for the Andrew K. Ruotolo, Jr. Memorial Scholarship, an applicant must be a New Jersey resident accepted for admission to a law school or graduate school.  The applicant must exhibit an interest in, and commitment to, enhancing the rights and well-being of children through child advocacy programs.  The applicant must also exhibit financial need.

 

To be eligible for the Harris Y. Cotton Memorial Scholarship, an applicant must be a New Jersey resident accepted for admission to a law school.  The applicant must have an interest in pursuing a career as a prosecutor with an emphasis in Domestic Violence or Hate Crime prosecutions.  The applicant must also demonstrate financial need.

 

To be eligible for the John H. Stamler Memorial Scholarship, an applicant must be a New Jersey resident and sworn law enforcement officer seeking educational advancement on a college or graduate level to improve his or her effectiveness as a law enforcement officer.  The applicant must also demonstrate financial need.

Applications must be postmarked by July 15, 2015.  Personal interviews of finalists will be conducted.  Applicants will be notified of the Committee’s decision in October, 2015.  Anyone interested in receiving an application can download same at www.cpanj.info.

Former Executor of Estate Sentenced for Misapplication Crime

Morris County Prosecutor Fredric M. Knapp announces that the Honorable Stuart A. Minkowitz, P.J.S.C. sentenced Bernard W. Ozarowski, Age 60, of Princeton, New Jersey to  serve 5 years of Special Probation pursuant to the terms of the Morris County Drug Court for second degree Misapplication of Entrusted Property in violation of N.J.S.A. 2C:21-15.  He was further ordered to pay restitution to four victims in the amount of $509,998.44.

 

On March 19, 2015, Ozarowski pled guilty to second degree Misapplication of Entrusted Property, in connection with his role as executor of the estate of R.H. who was Ozarowski’s brother-in-law.  R.H. was a former resident of Madison, New Jersey who died in December of 2011. At the time of his death, his life insurance policy, annuity funds, IRA accounts, certificates of deposit and other bank accounts contained significant assets. However, between December 8, 2011 and September 5, 2012, Ozarowski illegally transferred assets of the estate to his own company, Loyola Management, a dealer and distributor of print services as well as a document management company.

 

If the defendant violates the terms of the Special Probation he could be ordered to serve up to 10 years in the New Jersey State Prison. 

   

The State was represented during the sentencing by Morris County Supervising Assistant Prosecutor Francine S. Ehrenberg.

Roxbury High School Assistant Principal Charged with Sex Offenses

Morris County Prosecutor Fredric M. Knapp and Officer in Charge Martin McParland, Jr., of the Rockaway Township Police Department, announce that Roger Schneider, age 55, residing at 11 Notch Road, Rockaway Township, New Jersey, has been charged with Endangering the Welfare of a Child, in violation of N.J.S.A.2C:24-4a(1), a crime of the 2nd degree, and Aggravated Criminal Sexual Contact, in violation of N.J.S.A. 2C:14-3a, a crime of the 3rd degree. Schneider is the Assistant Principal at Roxbury High School.

 

During the week of April 20, 2015, the alleged victim (referred to by the fictitious initials X.X.) disclosed to a third person that Schneider had sexually touched X.X. Schneider was subsequently interviewed on or about April 24, 2015, and admitted committing acts of contact upon X.X.’s intimate parts. During a subsequent interview by law enforcement, X.X. disclosed acts of sexual contact between Schneider’s hand and X.X.’s genitals. X.X. resided part time at the defendant’s home between the dates of August of 2013 and January of 2015. The defendant was acting in loco parentisto the victim with X.X.’s parents’ consent. X.X. was 15 years old at the time of the alleged incidents. X.X. is not a student in the Roxbury school district.

 

On April 24, 2015, the Honorable Gerard Smith, J.M.C., authorized charges against Schneider for Endangering the Welfare of a Child, in violation of N.J.S.A.2C:24-4a(1), a crime of the 2rd degree, and Aggravated Criminal Sexual Contact, in violation of N.J.S.A. 2C:14-3a, a crime of the 3rd degree. Schneider was arrested by the Rockaway Police Department on April 25, 2015, and bail was set at $100,000 with no 10% option, no contact with the victim, and surrender of any firearms. 

 

The investigation is active and ongoing.  No other information is being released at this time.

Mt. Olive Man Charged With Arson

Morris County Prosecutor Fredric M. Knapp and Mount Olive Police Chief Mark Spitzer announce that John Maulbeck Jr. (age 23) a resident of the Flanders section of Mt. Olive Township, New Jersey has been charged with Arson, in violation of N.J.S.A 2C:17-1b2, a crime of the third degree. Maulbeck was arrested today following an investigation conducted by the Mt. Olive Police Department and the Morris County Prosecutor’s Office Arson/Environmental Unit.

On April 28, 2015 at approximately 7:05 p.m., members of the Mount Olive Police Department and the Flanders Fire Department were dispatched to 130 US 206 South in Flanders, New Jersey on a report of a house fire. Responders located an active fire to the attached garage of a single family home. A resident of the home, suffered injury due to smoke inhalation and was treated and released from the hospital.
 
The Honorable Brian J. Levine, J.M.C., Mount Olive set bail at $30,000 with 10% option. The defendant was unable to post bail and was remanded to the Morris County Correctional Facility.
