Dover Man Charged with Murder

Morris County Prosecutor Fredric M. Knapp and Town of Dover Police Chief Harold Valentine announce that Daneri Javier-Medina, 21 years old, of Dover, New Jersey, has been charged with Murder and weapons related crimes. The victim has been identified as Jacinto Flores Zapata, 39 years old, of Dover, New Jersey.

Daneri Javier-Medina is alleged to have stabbed the victim outside of Xclusiv Lounge located at 337 East Blackwell Street, Dover, New Jersey during the early morning hours of November 24, 2014.  The victim was found suffering from multiple stab wounds and pronounced dead a short time later.  An investigation was conducted by members of the Morris County Prosecutor’s Office Major Crimes Unit and Town of Dover Police Department which led to the arrest of Danier Javier-Medina. The Morris County Sheriff’s Office Crime Scene Investigations Unit and K-9 Unit were also instrumental in this investigation.

Javier-Medina was charged by way of Warrant-Complaint with Murder, a crime of the first degree, in violation of N.J.S.A.2C:11-3, Unlawful Possession of a Weapon, a crime of the fourth degree, in violation of N.J.S.A. 2C:39-5, and Possession of a Weapon for an Unlawful Purpose, a crime of the third degree, in violation of N.J.S.A.2C:39-4.

The Honorable Stuart A. Minkowitz, P.J.Cr. set bail in the amount of $500,000 cash, bond or property, with additional conditions set by the Court.

Enhanced Security Measures for West Morris Mendham High School

Morris County Prosecutor Fredric M. Knapp, Mendham Borough Police Chief Pasquale G. Libertino and Morris County Sheriff Edward Rochford announce enhanced security measures that will be in place for the start of the school day on Monday, December 8, 2014, at West Morris Mendham High School in Mendham Borough, New Jersey.

Law enforcement authorities are pursuing an ongoing investigation into a threat towards the West Morris Mendham High School. As a result, added security measures will be put into place to ensure the safety of the students, faculty and employees at the school.

As this is an active investigation, no further information as to the nature of the investigation will be released until further notice.

Juvenile Charged with One Count of False Public Alarm

Morris County Prosecutor Fredric M. Knapp and Mendham Borough Police Chief Pasquale G. Libertino announce today that a fifteen year old juvenile has been charged with one count of False Public Alarms, a crime of a third degree, related to an alleged threat towards the West Morris Mendham High School. 

Prosecutor Knapp would like to thank the Mendham Borough Police Department, the Morris County Sheriff’s Office, and members of the Major Crimes Unit of the Morris County Prosecutor’s Office for their collective assistance in this matter.

A juvenile complaint is merely an accusation.  Despite this accusation, the juvenile is presumed innocent unless and until each charge has been proved beyond a reasonable doubt.

Former Florham Park Board of Education President Pleads Guilty to Theft

Morris County Prosecutor Fredric M. Knapp announces that John MacFarlane, 52 years old, former financial controller of the Music Shop located in Boonton, pleaded guilty to one count of third degree Theft pursuant to N.J.S.A. 2C:20-3a.  MacFarlane is a former resident of Florham Park, New Jersey and currently resides in San Tan Valley, Arizona.  

Between February 26, 2007 and March 4, 2011, MacFarlane stole money from the Music Shop’s checking account and used the monies to make payments on his personal Capital One credit card.  MacFarlane’s plea agreement calls for him to serve 364 days in the county jail as a condition of serving 5 years of probation.  MacFarlane will have to pay $150,000 in restitution to the owners of the Music Shop.  

MacFarlane was the President of the Florham Park Board of Education for 7 years, from 2002 to 2009.  He stepped down in October of 2009, citing personalreasons for his decision to leave the school board. 

The State was represented during the guilty plea by Morris County Supervising Assistant Prosecutor Francine S. Ehrenberg in this matter.

North Bergen Man Sentenced to 30 Years in Connection with 2011 Killing

Morris County Prosecutor Fredric M. Knapp announces that the Honorable Robert J. Gilson, J.S.C. sentenced Carlos Rojas, 24 years old, of North Bergen, New Jersey, to 30 years in New Jersey State Prison in connection with the August 2011 killing of Esteban Hernandez.

On October 30, 2014, Carlos Rojas was found guilty by a jury of Aggravated Manslaughter, a crime of the first degree; Kidnapping, a crime of the first degree; Disturbing, Desecrating Human Remains, a crime of the second degree; Possession of a Weapon for Unlawful Purposes, a crime of the third degree; Theft From a Person, a crime of the third degree; Theft by Unlawful Taking, a crime of the third degree; and Hindering Apprehension or Prosecution, a crime of the third degree.

This prosecution stemmed from an investigation into the death of Esteban Hernandez, who was found beaten to death in the trunk of a car on August 4, 2011 in a wooded area in Lincoln Park, New Jersey.  The subsequent investigation would reveal that the victim had been killed in Fairview, New Jersey the previous day, August 3, 2011.   

Judge Gilson sentenced the defendant to 30 years in State Prison.  The Court imposed a 17 year period of parole ineligibility as to the charge of Aggravated Manslaughter pursuant to the No Early Release Act.  This aggregate sentence of 30 years encompassed consecutive sentences for Aggravated Manslaughter, Disturbing, Desecrating Human Remains, and Hindering Apprehension.

Supervising Assistant Prosecutor Matthew Troiano and Assistant Prosecutor Justin Tellone represented the State during the prosecution of this matter.

Prosecutor Knapp stated, “This was an especially brutal homicide.  The defendant has shown no remorse nor contrition for his acts, therefore, this sentence is certainly warranted.  Supervising Assistant Prosecutor Troiano and Sergeant Brylinski did an exceptional job and are to be commended.”

Bloomfield Man Sentenced to 20 Years for Theft and Fraud

Morris County Prosecutor Fredric M. Knapp announces that the Honorable Thomas J. Critchley, Jr., J.S.C. sentenced Robert Kosch, 58 years old, of Bloomfield, New Jersey to an aggregate sentence of 20 years in State Prison for multiple counts of Theft, Fraud, and Possession of Personal Identifying Information.

On October 14, 2014, a Sussex County jury found the defendant guilty of two counts of second degree Theft of Immovable Property, one count of third degree Theft of Immovable Property, two counts of third degree Theft of Movable Property, two counts of third degree Fraud, and one count of second degree Possession of Personal Identifying Information.  The charges stemmed from the defendant’s operation of Floaters, LLC, a business involved in foreclosure rescues and the purchase of real estate in various towns in Sussex County. The defendant targeted individuals in financial distress and who had moved out of their homes. He forged signatures on various deeds transferring ownership of properties to himself or Floaters, LLC without the consent of the homeowners.  He then proceeded to rent out the properties and collect the rental income.  The defendant was also found to be in possession of personal identifying information belonging to over one hundred individuals for the purposes of locating other property owners.

Judge Critchley sentenced the defendant to an aggregate sentence of 20 years in State Prison.  The defendant is required to serve 6 years before becoming eligible for parole.

Fatality in Morristown Residential Fire

Morris County Prosecutor Fredric M. Knapp and Morristown Police Chief Peter Demnitz announce an on-going investigation into a fatal fire that occurred on December 14, 2014 at 1 Shady Lane, Morristown, New Jersey.  

The investigation has revealed that an adult female died during the course of a fire at her personal residence.  No other injuries were reported and the fire was extinguished due to efforts of first responders. Notification of the fire was received this morning.

This is an active investigation. Personnel from the Morristown Police Department and the Morris County Prosecutors Major Crimes Unit have responded to the scene.  Further information will be made available once the investigation concludes and the Medical Examiner has conducted a post-mortem examination.

Parsippany Man Charged with Aggravated Sexual Assault

Morris County Prosecutor Fredric M. Knapp and Parsippany-Troy Hills Police Chief Paul Philipps announce that Jorge Perez, 31 years old, of Parsippany, New Jersey, has been charged with First Degree Aggravated Sexual Assault.

In November, 2014, the defendant allegedly engaged in sexual intercourse with a 14 year-old female while the female was intoxicated. It is further alleged that the defendant purchased the alcohol for the victim prior to the sexual assault.

Perez was arrested on December 17, 2014, following an investigation conducted by the Parsippany-Troy Hills Police Department and the Morris County Prosecutor’s Office Sex Crimes/Child Endangerment Unit. The investigation was led by Sergeant Susan Johnson and Detective James Bruno of the Morris County Prosecutor’s Office and Detective John Keiling of the Parsippany-Troy Hills Police Department. The defendant has been charged with Aggravated Sexual Assault, Sexual Assault, Aggravated Criminal Sexual Contact, and two counts of Endangering the Welfare of Children.

The investigation was initiated by information forwarded to law enforcement authorities by the 14 year-old female and a second cooperating individual. It is alleged that the defendant subsequently admitted to police that he had engaged in sexual intercourse with the 14 year-old female after she had been drinking alcohol.

The Honorable Maryann Nergaard, J.S.C., set bail at $250,000 with no ten percent option.  Defendant is to have no contact with the victim. The defendant was remanded to the Morris County Correctional Facility.

Newark Man on Parole Supervision Arrested on a Variety of Charges

Morris County Prosecutor Fredric M. Knapp and Morristown Police Chief Peter Demnitz announce the arrest of Terrel Hyman (AKA “Rel” and “Cuddy”), 32 years old, of Newark, New Jersey on a variety of charges including 2nd degree Eluding, 4th degree Aggravated Assault on a Law Enforcement Officer, 2nd degree Aggravated Assault, 2nd degree Possession of Handgun while Committing a Drug Offense, 2nd degree Certain Persons not to Possess Weapons, 3rd degree Possession with Intent to Distribute CDS heroin, and 3rd degree Possession of CDS heroin. At the time of his arrest, Hyman was on parole supervision for a 2009 1st degree manslaughter conviction out of Essex County.

An investigation into a multi-county heroin distribution network culminated on Thursday December 18, 2014 when authorities executed several search warrants in Morris and Essex counties. While executing a search warrant in Morris County, Hyman allegedly denied the commands of police officers and created a tense scene by fleeing at a high rate of speed in a red 1999 Cadillac Seville. In the course of fleeing, Hyman is further alleged to have intentionally rammed a police vehicle carrying two uniformed Morristown officers before striking a second vehicle driven by a plain clothed officer. The vehicle operated by Hyman was found abandoned in the vicinity of several commercial buildings in Morristown.

A search warrant was subsequently executed at Hyman’s residence of 13th Street in Newark, where officers located several hundred bags of heroin packaged for street level distribution and a loaded handgun.

Within 24 hours, Morris County authorities were able to determine that Hyman fled the State and was inside a residence in Rockland County, New York. With the assistance of the Haverstraw Police Department, Rockland County Sheriff’s Office, Rockland County District Attorney’s Office and a multi-agency tactical team, officials were able to take Hyman into custody on Friday December 19, 2014. Hyman is currently incarcerated in New York while awaiting extradition back to New Jersey on these charges, as well as a parole violation. Bail was set by the Hon. Robert J. Gilson, J.S.C. at $250,000, cash only, with a bail source hearing requirement.

Also arrested during the course of the investigation was Lakema Holified of Morristown, 32, who was charged with 2nd and 3rd degree offenses for Possession with Intent to Distribute CDS heroin and cocaine, within 500 feet of Public Property, Possession with Intent to Distribute CDS within 1000 feet of a school, Possession with Intent to Distribute CDS, Possession of CDS, and Hindering.

The Honorable Michael J. Noonan, J.M.C. set bail for Holifield at $250,000 with no 10% with a bail source hearing requirement. Holifield was unable to post bail and remanded to the Morris County Correctional Facility.

“The Morris County Prosecutor’s Office Narcotics Task Force, along with our local police departments and other law enforcement partners will continue to aggressively pursue those individuals who import heroin into our community, contributing to the epidemic that is gripping our State”, Prosecutor Knapp stated. “This investigation demonstrates the coordinated efforts that will be utilized to bring these offenders to justice” he added. “I wish to acknowledge the work of the Morristown Police Department for the continuing partnership with this Office to protect the residents of Morris County.”

The investigation is active and ongoing. No other information is being released at this time.

Rockaway Man Arrested for Distribution and Possession of Child Pornography

Morris County Prosecutor Fredric M. Knapp and Chief Douglas Scheer of the Rockaway Borough Police Department announce the arrest of 63 year-old Gary J. Firuta, of Rockaway, New Jersey, on charges of Endangering the Welfare of a Child – Distribution of Child Pornography, a crime of the second degree, and Endangering the Welfare of a Child – Possession of Child Pornography, a crime of the fourth degree.

The acts in question allegedly began in 2011 and came to the attention of law enforcement through a tip from the National Center for Missing and Exploited Children. Firuta was arrested on December 22, 2014, following an investigation conducted by the Morris County Prosecutor’s Office Sex Crimes/Child Endangerment Unit and the Rockaway Borough Police Department. The investigation was led by Detective James Bruno of the Morris County Prosecutor’s Office and Detective Sergeant Kyle Schwartzman of the Rockaway Borough Police Department.

Denville Township Bank Robbery

Morris County Prosecutor Fredric Knapp and Denville Township Police Chief Christopher Wagner announce an active investigation into a bank robbery that occurred this morning in Denville Township, New Jersey.

At approximately 10:09 a.m., a report of a bank robbery was made involving an incident that occurred at the TD Bank, located at 298 East Main Street in Denville.

Initial reports indicated that a male entered the bank branch and demanded money. The male can be further described as an Asian male, approximately six (6) feet tall, who was seen wearing a black knit cap, black jacket, black gloves, yellow scarf and sunglasses.

The male is believed to have fled from the scene in a black, four-door sedan with tinted windows and chrome trim around the windows. The vehicle fled in the direction of Route 53 South towards Morris Plains, New Jersey.

Numerous law enforcement agencies have responded and are currently investigating, including the Major Crimes Unit of the Morris County Prosecutor's Office, the Denville Township Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, the New Jersey State Police, and the FBI.

Arrest Made in Denville Township Bank Robbery

Morris County Prosecutor Fredric M. Knapp and Denville Township Police Chief Christopher Wagner announce the arrest of Larry Zhou, thirty-one (31) years old of Morris Plains, New Jersey on a charge related to a robbery that occurred on December 27, 2014 at the TD Bank in Denville Township, New Jersey.

At approximately 10:09 a.m., a report of a bank robbery was made involving an incident that occurred at the TD Bank, located at 298 East Main Street in Denville.   

Numerous law enforcement agencies took part in this investigation, including the Major Crimes Unit of the Morris County Prosecutor's Office, the Denville Township Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, the New Jersey State Police, and the FBI. 

On December 29, 2014, Larry Zhou was charged with one count of Robbery, a crime of the second degree.  Bail was set at $125,000 full cash, bond or property without a ten percent option. The defendant was remanded to the Morris County Correctional Facility.

The charges and allegations are merely accusations, and the defendant is considered innocent unless and until proven guilty.

West Morris Mendham High School Teacher Arrested for Official Misconduct

Morris County Prosecutor Fredric M. Knapp and Chief Pasquale Libertino of the Mendham Borough Police Department announce the arrest of 32 year-old Nicole McDonough, of Mount Olive Township, New Jersey, on the charge of Official Misconduct, a crime of the second degree.

Law enforcement received information that the defendant, Nicole McDonough, engaged in a sexual relationship with an 18 year-old student while she was employed as a teacher at West Morris Mendham High School. The acts in question allegedly occurred in May and June of 2014.   McDonough was arrested on December 30, 2014, following an investigation conducted by the Morris County Prosecutor’s Office Sex Crimes/Child Endangerment Unit and the Mendham Borough Police Department. The investigation was led by Detective Bruce LaFera of the Morris County Prosecutor’s Office and Detective Chris Irons of the Mendham Borough Police Department.

Mountain Lakes Woman Arraigned on Forgery and Theft Charges Related to Siblings

Morris County Prosecutor Fredric M. Knapp announces that Matilda A. Mola, 66 years old, of the Borough of Mountain Lakes, New Jersey was arraigned today in the Morris County Superior Court in front of the Honorable Robert J. Gilson, J.S.C.  Mola was indicted on November 6, 2014 after an investigation revealed that she allegedly stole approximately $136,800 from her sister and her brother by forging her sister’s signature on ten courtesy checks totaling $136,800 from a Bank of America Line of Credit Account located in Boonton Township.  

Defendant was indicted on one count of second degree Theft, pursuant to N.J.S.A. 2C:20-3a and ten counts of third degree Forgery, pursuant to N.J.S.A.2C:21-1a(2).

The State was represented by Morris County Supervising Assistant Prosecutor Francine S. Ehrenberg in this matter.

Sussex Woman Charged with Eluding and Aggravated Assault

Morris County Prosecutor Fredric M. Knapp and Wharton Borough Police Chief Anthony Fernandez announce that Charity Thompson, 21 years old, of Sussex, New Jersey, has been charged with Second Degree Eluding and Aggravated Assault, Third degree Assault by Auto, Fourth Degree Causing Injury While Driving With a Suspended License, a Disorderly Person’s Offense of Possession of Drug Paraphernalia, and various motor vehicle summonses.

On January 1, 2015, at approximately 9:04 a.m., Wharton Borough Police attempted to conduct a motor vehicle stop for speeding of a tan Toyota Camry on Route 15 South in Wharton, New Jersey.  Charity Thompson was later identified as the driver of the Toyota Camry. 

Allegedly Charity Thompson ignored police commands to stop her vehicle and fled the scene at a high rate of speed.  She traveled south on Mount Hope Avenue in Rockaway Township, New Jersey, where she ultimately crashed her vehicle.  Thompson and another occupant were removed from the vehicle and transported to Morristown Medical Center for treatment for injuries sustained as a result of the crash. 

The Honorable Gerard Smith, J.M.C. set bail at $200,000, no 10 percent, cash, bond or property.

The investigation is active and ongoing.  No other information is being released at this time.

Succasunna Man Indicted for Robbing Wells Fargo Bank, Harmon Discount Store and Gas Station

Morris County Prosecutor Fredric M. Knapp and Roxbury Township Police Chief James Simonetti announce that Derek Morisco, 23 years old of Succasunna, New Jersey, was indicted today after an investigation revealed that he allegedly committed three separate robberies of various businesses located in Succasunna, New Jersey, within a span of four days.

            On March 31, 2014, at approximately 6:19 pm, Derek Morisco is alleged to have entered the Harmon Discount Store located at 274 Route 10 in Succasunna, New Jersey.  Once inside, Morisco allegedly passed a note to the cashier demanding money.  Morisco then fled the store on foot prior to receiving any money from the cashier. 

            On April 2, 2014, at approximately 9:20 pm, Morisco is also alleged to have approached the Fuel 10 gas station located at 65 Route 10 in Succasunna, New Jersey on his bicycle while armed with a knife.  He allegedly attempted to obtain money from the gas station attendant.  Morisco allegedly made continual unsuccessful attempts to enter a gas attendant booth during this incident.  Morisco then fled from the scene on his bicycle.     

            On April 3, 2014, at approximately 4:42 pm, Morisco is again alleged to have entered the Wells Fargo Bank located at 106 Route 10 West in Succasunna, New Jersey.  Once inside, Morisco allegedly passed a note to the teller demanding money and claiming to be armed.  Morisco received $1,065 from the teller, and then fled from the scene on foot.         

         The defendant was indicted on one count of second degree Robbery, two counts of first degree Robbery, one count of third degree Possession of a Knife for Unlawful Purpose, one count of fourth degree Unlawful Possession of a Knife, and one count of fourth degree Resisting Arrest.

            The case was presented by Assistant Prosecutor Sahil Kabse of the Morris County Prosecutor’s Office Major Crimes Unit.  The lead investigators on the case are Detective Michael Gomez of the Morris County Prosecutor’s Office Major Crimes Unit and Corporal Adam DelGuercio of the Roxbury Township Police Department.

            Prosecutor Knapp wishes to thank the Roxbury Police Department, the Morris County Sheriff’s Office Crime Scene Unit, and the Major Crimes Unit of the Morris County Prosecutor’s Office.

Former Property Manager and Superintendent of Chatham Apartment Complex Charged with Stealing From His Employers

Morris County Prosecutor Fredric M. Knapp and Chatham Borough Chief of Police Philip Crosson announce the indictment of Jerzy Michalak, 54 years old, former property manager and superintendent for Volker & Apgar Colonial Manor, Inc., an apartment complex located on Main Street in the Borough of Chatham.

Between January 5, 2012 and July 2, 2014, Jerzy Michalak allegedly rented out apartments within the Volker & Apgar Colonial Manor Apartment Complex while leading the corporation to believe that the apartments were vacant.  Michalak purportedly collected $81,760 in rent payments and security deposits from 17 tenants via check and cash payments and thereafter deposited the money into his personal bank account.  Michalak is alleged to have spent the money on personal expenses.

The investigation, conducted by Chatham Borough Police Detective Joseph Crecca with assistance from Morris County Prosecutor’s Office Agent John Jespersen, also revealed that the defendant allegedly stole approximately $15,000 in cash to include lottery winnings belonging to one of the owners of the apartment complex.

It is further alleged in the indictment that when the defendant was confronted by one of the owners of the business, he fraudulently used the business’ Visa credit card to purchase a one way ticket to Poland. Mr. Michalak has not been seen in the United States since he left for Poland on August 11, 2014.    

Defendant was indicted by the Morris County Grand Jury on one count of Second Degree Theft by Failure to Make the Required Disposition of Entrusted Property, pursuant to N.J.S.A. 2C:20-9; one count of Third Degree, Misapplication of Entrusted Property, pursuant to N.J.S.A.2C:21-15; one count of Third Degree Theft by Unlawful Taking, pursuant to N.J.S.A.2C:20-3(a) and one count of Third Degree Fraudulent Use of a Credit Card, pursuant to N.J.S.A. 2C:21-6h. 

The State is represented by Supervising Assistant Prosecutor Francine Ehrenberg.

Prosecutor Fredric M. Knapp Announces Investigative and Legal Staff Promotions

Morris County Prosecutor Fredric M. Knapp today announced several promotions of investigative and legal personnel. The promotions, and accompanying transfers of personnel, shall provide for more effective command of the various legal and investigative units of the office.

Prosecutor Knapp stated, “We are always striving to optimize the performance of the Morris County Prosecutor’s Office to support our service to the citizens of Morris County.  These promotions and transfers are necessary to meet the ever-increasing demands in the investigation and prosecution of criminal offenders.”
The following personnel will be promoted today with their new command assignments indicated.

  • Captain Denise Arseneault to Deputy Chief, will command all investigative                        personnel and will report directly to Chief of Investigations John R. Speirs.
  • Lieutenant Jane Recktenwald to Captain, will command the Special Operations Division.
  • Sergeant Steven Murzenski to Lieutenant, will command the Professional Standards, Financial Crimes, Insurance Fraud and Bias Crimes Units.
  • Detective Supervisor Christoph Kimker to Sergeant, will supervise the Professional Standards, Financial Crimes, Insurance Fraud and Bias Crimes Units.
  • Detective Michelle Timmons to Detective / Supervisor, will supervise the Domestic Violence and Weapons Return Units.

In addition, Alexis Keller, Esq. was sworn in as an Assistant Prosecutor today.  She was most recently employed by the Morris County Prosecutor’s Office as a Legal Assistant until her swearing in.  She previously served as the law clerk to the Honorable Liliana S. DeAvila-Silebi, Presiding Judge, Criminal Division, Bergen County.  A.P. Keller will divide her assigned duties between the Civil Forfeiture Unit and the Appellate Unit.

The promotions were effective Monday, February 2, 2015, but the promotional ceremony was rescheduled because of the closure of County Offices due to the snow and ice storms.

Arrest Made in Kinnelon Murder

Morris County Prosecutor Fredric Knapp and Kinnelon Borough Police Chief John Schwartz announce the arrest of Travis J. Hofstetter, eighteen (18) years old, of Kinnelon, New Jersey on charges related to the shooting death of his father, James E. Hofstetter, age fifty-seven (57), inside their Kinnelon residence located at 15 Wedgewood Drive in Kinnelon, New Jersey. 

On February 15, 2015 at approximately 4:15 p.m., Kinnelon Borough Police were dispatched to the residence at 15 Wedgewood Drive on the report of an unknown medical emergency.

Upon arrival, officers from the Kinnelon Borough Police Department located a deceased male, identified as James E. Hofstetter.  The decedent suffered from apparent gunshot wounds. 

Travis J. Hofstetter, the son of the decedent, was later arrested by officers with the Hardyston Township Police Department near the Skylands Ice World, located on Route 23 in Stockholm, New Jersey.  

Numerous law enforcement agencies took part in this investigation, including the Major Crimes Unit of the Morris County Prosecutor's Office, the Kinnelon Borough Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, the Hardyston Township Police Department, and the Morris County Medical Examiner’s Office.   

On February 16, 2015, Travis J. Hofstetter was charged with one count of Murder, a crime of the first degree, in violation of N.J.S.A. 2C:11-3a(1); one count of Possession of a Weapon for an Unlawful Purpose, a crime of the second degree, in violation of N.J.S.A. 2C:39-4a; and one count of Unlawful Possession of a Weapon, a crime of the second degree, in violation of N.J.S.A. 2C:39-5b.  Bail was set at $750,000 cash only, with additional conditions.  The defendant was remanded to the Morris County Correctional Facility.

Defendant Sentenced to State Prison in Multi-State Cocaine Distribution Network

Morris County Prosecutor Fredric M. Knapp, announces the conviction and sentencing of Julio Santana, 52 years old, of the Bronx, New York, who pled guilty on December 9, 2014 to one count of first degree Possession with Intent to Distribute Cocaine. On Friday, the Honorable Stuart A. Minkowitz, P.J.Cr. sentenced Santana to 12 years in New Jersey State Prison. He is required to serve 54 months before being considered for parole. Santana, who was born in the Dominican Republic and is in the United States as a legal permanent resident, also faces pending charges out of New York for cocaine allegedly found in his residence during the execution of a search warrant on the date of his arrest.

Santana was arrested on September 10, 2014 along with 15 other individuals who were operating a multi-state cocaine distribution network encompassing Morris, Passaic, Bergen, Hudson and Union counties in New Jersey and New York City. While several co-defendants have also entered guilty pleas and are currently awaiting sentencing, Santana is the first upper echelon member of the distribution network to be convicted and sentenced. The remaining co-defendants’ charges have been referred to a Morris County Grand Jury for consideration.

The Narcotics Task Force of the Morris County Prosecutor’s Office cultivated this intelligence with members of the Morristown Bureau of Police, which ultimately led to the assembling of a multi-agency task force to investigate this illicit interstate drug distribution enterprise that was geographically spread over five counties in New Jersey, as well as New York City.  Law enforcement was able to effectively infiltrate and dismantle this drug distribution network responsible for the importation of multiple kilograms of cocaine into New Jersey. The vast majority of those arrested were over forty years of age, the oldest being 69 years old.

The 5-month long investigation culminated on September 10, 2014 with the arrest of Santana and 15 other individuals, the execution of several search warrants in New Jersey and New York, the seizure of in excess of 930 grams of cocaine, approximately 4 pounds of marijuana, 13 vehicles used by the defendants during the illegal activity and over $7,000 in cash proceeds from drug sales. The bulk quantity of cocaine seized had a “retail” street value in excess of $93,000.

Prosecutor Knapp stated “This sentence demonstrates the severity with which illicit drug dealers should be punished.  It serves as a deterrent to not just this defendant but also to others who would perpetuate similar crimes in Morris County.”

The following individuals were arrested and charged as indicated:

1.      Julio C. Santana, age 51, of Bronx, New York, is alleged to have imported bulk quantities of cocaine into New Jersey that he sold to numerous New Jersey based street level cocaine distributors. Santana was charged with:

(1) Count Distribution of Cocaine greater than 5 ounces, (1st Degree)
(6) Counts of Possession of Cocaine, (3rd Degree)

(4) Counts of Distribution Cocaine greater than one-half ounce, (2nd Degree)
(1) Count Conspiracy to Possess Cocaine, greater than 5 ounces, (3rdDegree)
(1) Count Conspiracy to Possess Cocaine with Intent to Distribute, greater than 5 ounces, (2nd Degree)
(1) Count Conspiracy to Distribute Cocaine, greater than 5 ounces, (2ndDegree)

Santana was lodged in the Morris County Correctional Facility on a $500,000 no 10% bail.


2.      Jairo Rada-Medina, age 44, of Dover, NJ was charged with:

4.      Carlos Andreas Salinas-Cartagena, age 35, of Lake Hiawatha, NJ was charged with:

Salinas-Cartegena was released on his own recognizance.


5.       Aubrey Ward, age 64, of Englewood, NJ was charged with:

(1) Count of Conspiracy to Possess Cocaine, (3rd Degree)      
(1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)

Ward was lodged in the Morris County Correctional Facility on $150,000 no 10% bail


6.      Clarence Edward West, Jr., age 65, of Englewood, NJ was charged with:

(1) Count of Conspiracy to Possess Cocaine, (3rd Degree)                                   
(1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)

West was lodged in the Morris County Correctional Facility on $100,000 no 10% bail.

(1)   Count of Possession of Cocaine, (3rd Degree)
(1)   Count of Possession of Cocaine w/Intent to Distribute

Santa was lodged in the Morris County Correctional Facility on $125,000 no 10% bail.


9.      Daniel Payamps, age 44, of Paterson, NJ was charged with:

(1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
(1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)

Payamps bail was set at $150,000 no 10% as a detainer and is lodged in the Passaic County Correctional Facility on another pending charge.

         
Carlos Escobar, age 27, of Dover, NJ was charged with: 
(1) Conspiracy to Possess Cocaine, (3rd Degree)                                     
(1) Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2ndDegree)

Escobar was lodged in the Morris County Correctional Facility on $150,000 no 10% bail.


11.  Alberto Diaz-Moreno, age 45, of Elizabeth, NJ was charged with:

Diaz-Moreno was lodged in the Morris County Correctional Facility on $10,000 with 10% option.


12.  Jose Suarez, age 44, of Union City, NJ was charged with:

Suarez was lodged in the Morris County Correctional Facility on $150,000 no 10% bail.


13.  Pablo C. Lopez, age 69, of Union City, NJ was charged with:

Lopez was released on his own recognizance.


14.  Camilo Rogelio, age 46, of New York, NY was charged with:

Rogelio was lodged in Riker’s Island and is awaiting extradition to New Jersey


15.  Angelica G. Villanueva, age 26, of Dover, NJ was charged with:

(1)   Count of Possession of Marijuana over 50 grams, (4th Degree)
(1)   Count of Possession w/Intent to Distribute Marijuana greater than 1 oz, (3rd Degree)

Villanueva was released on her own recognizance.
                              

16.  Rosemberg Giraldo-Arboleda, age 48, of Madison, NJ was charged with:

(1) Count of Conspiracy to Possess Cocaine, (3rd Degree)   

Giraldo-Arboleda was released on his own recognizance.


The Honorable Stuart A. Minkowitz, P.J.Cr. authorized the warrant complaints and bails for all defendants.

The investigation was led by Captain Michael Rice, Lieutenant V. Harrison Dillard and Sergeant Joseph Costello of the Morris County Prosecutor’s Office Special Operations Division.  The prosecution is being handled by Assistant Prosecutor Joseph Napurano of the Special Operations Division and supervised by Supervising Assistant Prosecutor Bradford Seabury.
