Juvenile Charged with Two Counts of Death by Auto and One Count of Assault by Auto

Morris County Prosecutor Fredric M. Knapp and Randolph Police Chief David Stokoe announce today that a juvenile has been charged with two counts of Death by Auto and one count of Assault by Auto stemming from a fatal motor vehicle crash that occurred on July 26, 2014 in the Township of Randolph near 48 Ironia Road.  The name of the juvenile, as well as the victims, are not being released due to their ages. 

Prosecutor Knapp would like to thank the Township of Randolph Police Department, the Morris County Sheriff’s Office Criminal Investigation Section, the Township of Randolph Fire Department, and members of the Major Crimes Unit of the Morris County Prosecutor’s Office for their collective assistance in this matter.

A criminal complaint is merely an accusation.  Despite this accusation, the defendant is presumed innocent unless and until he or she has been proven guilty beyond a reasonable doubt in a court of law.

Morris County Narcotics Task Force Makes Multiple Arrests for a Multi State Cocaine Distribution Network

Morris County Prosecutor Fredric M. Knapp, announces the arrest of 16 individuals operating a multi-state cocaine distribution network encompassing Morris, Passaic, Bergen, Hudson and Union counties in New Jersey and New York City. This case was initiated in April of this year based on intelligence gathered by an astute Morristown Bureau of Police patrolman. The Narcotics Task Force of the Morris County Prosecutor’s Office cultivated this intelligence with members of the Morristown Bureau of Police, which ultimately led to the assembling of a mulit-agency task force to investigate this illicit interstate drug distribution enterprise that was geographically spread over five counties in New Jersey, as well as New York City. Law enforcement was able to effectively infiltrate and dismantle this drug distribution network responsible for the importation of multiple kilograms of cocaine into New Jersey. An interesting note of the dismantling of this illicit drug distribution enterprise is that the vast majority of those arrested were older, with thirteen more than forty years of age with the oldest being 69 years old. Six of the subjects arrested were identified as past violent offenders.

The 5-month long investigation concluded Wednesday with the arrest of 16 individuals for various cocaine distribution charges, the execution of numerous search warrants, the seizure of in excess of 930 grams of cocaine, approximately 4 pounds of marijuana, 13 vehicles used by the defendants during the illegal activity and over $7,000 in cash proceeds from drug sales. The bulk quantity of cocaine seized has a “retail” street value in excess of $93,000.

The following individuals were arrested and charged as indicated:
  1. Julio C. Santana, age 51, of Bronx, New York, is alleged to have imported bulk quantities of cocaine into New Jersey that he sold to numerous New Jersey based street level cocaine distributors. Santana was charged with:
  • (2) Counts Possession of Cocaine with Intent to Distribute greater than 5 ounces, (1st Degree)
  • (1) Count Distribution of Cocaine greater than 5 ounces, (1st Degree)
  • (6) Counts of Possession of Cocaine, (3rd Degree)
  • (4) Counts of Possession of Cocaine with Intent to Distribute greater than one-half ounce, (2nd Degree)
  • (4) Counts of Distribution Cocaine greater than one-half ounce, (2nd Degree)
  • (1) Count Conspiracy to Possess Cocaine, greater than 5 ounces, (3rd Degree)
  • (1) Count Conspiracy to Possess Cocaine with Intent to Distribute, greater than 5 ounces, (2nd Degree)
  • (1) Count Conspiracy to Distribute Cocaine, greater than 5 ounces, (2nd Degree)
  • Santana was lodged in the Morris County Correctional Facility on a $500,000 no 10% bail.
  • Jairo Rada-Medina, age 44, of Dover, NJ was charged with:
    • (2) Counts of Conspiracy to Possess Cocaine, (3rd Degree)
    • (2) Counts of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • (1) Count of Conspiracy to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Rada-Medina was lodged in the Morris County Correctional Facility on $150,000 no 10% bail.
  • Johel Teo, age 43, of Rockaway, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • (1) Conspiracy to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Teo was lodged in the Morris County Correctional Facility on $150,000 no 10% bail
  • Carlos Andreas Salinas-Cartagena, age 35, of Lake Hiawatha, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • Salinas-Cartegena was released on his own recognizance.
  • Aubrey Ward, age 64, of Englewood, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Ward was lodged in the Morris County Correctional Facility on $150,000 no 10% bail
  • Clarence Edward West, Jr., age 65, of Englewood, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • West was lodged in the Morris County Correctional Facility on $100,000 no 10%
  • Mingo R. Roach, age 53, of Dumont, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • (1) Count of Possession of Cocaine, (3rd Degree)
    • Roach was lodged in the Morris County Correctional Facility on $100,000 no 10% bail.
  • Israel Santa, age 51, of Dover, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Possession of Cocaine, (3rd Degree)
    • (1) Count of Possession of Cocaine w/Intent to Distribute
    • Santa was lodged in the Morris County Correctional Facility on $125,000 no 10% bail.
  • Daniel Payamps, age 44, of Paterson, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Payamps bail was set at $150,000 no 10% as a detainer and is lodged in the Passaic County Correctional Facility on another pending charge.
  • Carlos Escobar, age 27, of Dover, NJ was charged with:
    • (1) Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Escobar was lodged in the Morris County Correctional Facility on $150,000 no 10% bail.
  • Alberto Diaz-Moreno, age 45, of Elizabeth, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • Diaz-Moreno was lodged in the Morris County Correctional Facility on $10,000 with 10% option.
  • Jose Suarez, age 44, of Union City, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Suarez was lodged in the Morris County Correctional Facility on $150,000 no 10% bail.
  • Pablo C. Lopez, age 69, of Union City, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • Lopez was released on his own recognizance.
  • Camilo Rogelio, age 46, of New York, NY was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • (1) Count of Conspiracy to Poss. w/ Intent to Distribute Cocaine, greater than one-half ounce, (2nd Degree)
    • Rogelio was lodged in Riker’s Island and is awaiting extradition to New Jersey
  • Angelica G. Villanueva, age 26, of Dover, NJ was charged with:
    • (1) Count of Possession of Marijuana over 50 grams, (4th Degree)
    • (1) Count of Possession w/Intent to Distribute Marijuana greater than 1 oz, (3rd Degree)
    • Villanueva was released on her own recognizance.
  •  Rosemberg Giraldo-Arboleda, age 48, of Madison, NJ was charged with:
    • (1) Count of Conspiracy to Possess Cocaine, (3rd Degree)
    • Giraldo-Arboleda was released on his own recognizance.
    The Honorable Stuart A. Minkowitz, P.J.Cr. authorized the warrant complaints and bails for all defendants.

    Prosecutor Knapp stated: “I am particularly pleased with the success of this operation as the majority of the subjects arrested were wholesale drug distributors as opposed to lower level drug dealers or users. The Morris County Prosecutor’s Office Narcotics Task Force partners with other law enforcement agencies to aggressively pursue networks and individuals who import illegal drugs into our communities. This investigation demonstrates how the cooperation of multiple agencies, even on an interstate basis, can effectively thwart the efforts of dealers who are bringing illegal drugs into Morris County”.

    The investigation was led by Captain Michael Rice, Lieutenant V. Harrison Dillard and Sergeant Joseph Costello of the Morris County Prosecutor’s Office Special Operations Division. The prosecution is being handled by Assistant Prosecutor Joseph Napurano of the Special Operations Division and supervised by Supervising Assistant Prosecutor Bradford Seabury.

    Morristown Man Indicted on Attempted Murder and Robbery Charges

    Morris County Prosecutor Fredric M. Knapp and Morristown Police Chief Peter Demnitz announce that Brandon Johnson, 23 years old, of Morristown, New Jersey, was indicted yesterday after an investigation revealed that he was allegedly involved in an incident involving a shooting and a robbery which occurred on Lincoln Street in Morristown on January 31, 2014.             

    Johnson was indicted on one count of First Degree Attempted Murder; two counts of First Degree Robbery, one count of Fourth Degree Conspiracy to Possess CDS, one count of Second Degree Unlawful Possession of a Weapon; and other weapons related offenses.

    The State is represented by Assistant Prosecutor Sahil Kabse in this matter.

    Denville Man Sentenced to 50 Years for the Murder of His Ex-Wife

    Morris County Prosecutor Fredric M. Knapp announces that the Honorable Robert J. Gilson, J.S.C. sentenced Anthony F. Novellino, 67 years old, of Denville, New Jersey to 50 years in State Prison for the murder of his ex-wife, Judith Novellino.

    On July 23, 2014, a jury found the defendant guilty of Murder, Possession of a Weapon for Unlawful Purposes, Unlawful Possession of a Weapon, Hindering Own Apprehension and Tampering with Physical Evidence in connection with the stabbing death of his ex-wife on June 19, 2010.  Judith Novellino was 62 years old at the time of her death and had recently divorced the defendant.  The murder occurred at the former marital home in Denville, when she was packing some of her belongings in an effort to move out of the home.  The defendant arrived at the home, stabbed his ex-wife 84 times and placed a pig’s mask over her face before he fled to Puyallup, Washington.

    Judge Gilson sentenced the defendant to 50 years in State Prison.  Defendant is required to serve 85 percent of his sentence under New Jersey’s No Early Release Act (NERA) before becoming eligible for parole.  All other sentences are to run concurrent.

    Executive Assistant Prosecutor Maggie Calderwood and Supervising Assistant Prosecutor Tia Manochio represented the State at the sentencing.

    Prosecutor Knapp stated, “The sentence imposed by the Court is fitting given the unspeakable nature of the crimes committed by the defendant.  This was a despicable and cowardly murder and was punctuated by a final horrific insult.  We hope that the friends and family of Judy Novellino will now have some sense of finality.”

    Prosecutor Knapp thanked Denville Township Police Chief Christopher Wagner and the Denville Township Police Department; Sheriff Edward Rochford and the Morris County Sheriff’s Office Criminal Investigation Section; the Puyallup Washington Police Department; the Morris County Medical Examiner’s Office; the Morris County Prosecutor’s Office Major Crimes and General Investigations Unit for their efforts resulting in today’s sentence.

    MCPO Implements Program in Morris County to Prevent Fatal Heroin and Opiate Overdoses

    Morris County Prosecutor Fredric M. Knapp announces today the formal launch of a Nasal Narcan® (Naxolone) program in Morris County that will train and equip Morris County police officers to administer the antidote Narcan® to persons suffering from an overdose of heroin or prescription Opiates.  The Morris County Narcan® Program is a partnership between the Morris County Prosecutor’s Office, municipal police departments and Atlantic Ambulance Corporation.  The Morris County Prosecutor’s Office arranged with Atlantic Ambulance Corporation to provide training and medical oversight to all participating Morris County municipal police departments that opt to participate in the Narcan® Program. 

    This training commenced today with 54 police officers attending a training class at the Morris County Public Safety Training Academy.  Over the next few months participating police departments will have their officers trained in the use of the life saving antidote.

    Earlier this year, a pilot Naxolone program was authorized by the New Jersey Attorney General’s Office in South Jersey.  The program has been credited with saving numerous lives.  Upon receiving authorization for a state-wide implementation the Morris County Prosecutor’s Office partnered with Atlantic Ambulance Corporation to develop a Standard Operating Procedure and Training Protocol, modeled after the successful South Jersey program, that will assist Morris County municipal police departments in deploying this life saving antidote into our communities.

    Naloxone is an opioid antagonist that can be used to counter the effects of opiate overdose.  There are no reported complications from the administration of the antidote.  Naloxone displaces opioids from the receptors in the brain that control the central nervous system and respiratory system.  An aerosol form of naloxone, Narcan® is administered nasally through use of a syringe-atomizer. 

    In Morris County, trained and certified police officers will be provided equipment for use in administering the drug, including medical gloves, syringe-atomizer, and a facemask for rescue breathing.

    Unfortunately, police officers are encountering significant numbers of overdoses from opiates in the form of heroin, morphine, methadone, codeine, oxycodone (OxyContin®, Percocet® and Percodan®) and hydrocodone (Vicodin®).  In 2013 Governor Christie signed the Overdose Prevention Act (P.L. 2013 c.46).  The Act eliminates civil liability for both health care professionals dispensing Narcan® and for “trained” individuals administering the drug and is the foundation legislation that allows law enforcement officers to carry the antidote.

    Prosecutor Knapp stated: “The heroin in our communities is at a historically high potency level resulting in many overdoses.  Narcan®, is another tool that will be deployed by our law enforcement community to tackle this potent poison.  The Morris County Prosecutor’s Office is taking a dynamic approach to combating our opiate epidemic.  We will continue to increase our narcotics enforcement efforts that target drug dealers spreading poison into our communities.  However, we must also deploy tools like Narcan® to confront this state-wide narcotics epidemic and help prevent the unnecessary deaths of citizens suffering with opiate addictions.”

    Morris County Prosecutor's Office Joins 9th Annual Operation Take-Back Day

    Morris County Prosecutor Fredric M. Knapp, Chief of Investigations John R. Speirs, Morris Plains Police Chief Jason Kohn, Randolph Township Police Chief David Stokoe and Mountain Lakes Police Chief Shawn Bennett announce their agencies will be acting in conjunction on Saturday, September 27, 2014, joining the 9th Annual Operation Take-Back Day program.

    Operation Take-Back is a national initiative that encourages individuals to turn in unused or expired prescriptions, controlled substances and over-the-counter medications for safe disposal. The medication collection will allow citizens to give their unused medications to law enforcement officials without releasing personal information. After the event, law enforcement officials will dispose of the medications collected in an environmentally safe manner.

    Operation Take-Back will be held in conjunction with the Morris County Prosecutor’s Office on September 27, 2014, from 10:00A.M. to 2:00 P.M. at the following three locations:

    Morris Plains, New Jersey 07950

    Randolph Township Municipal Building
    502 Millbrook Road
    Randolph, New Jersey 07869

    In addition to helping individuals dispose of unused prescription drugs, Operation Take-Back promotes awareness of juvenile prescription drug prevention efforts.

    Operation Take Back is a collaborative effort between the New Jersey Office of the Attorney General, New Jersey Division of the Drug Enforcement Administration, New Jersey Prevention Network, New Jersey Chiefs’ of Police Association, Morris Plains Police Department, Randolph Police Department, Stop and Shop Supermarket, Mountain Lakes Police Department and the Morris County Prosecutor’s Office. This initiative also includes numerous other drop off sites nationwide and also throughout Morris County.     Two Deaths Investigated in Roxbury Township

    Morris County Prosecutor Fredric M. Knapp and Roxbury Township Police Chief James Simonetti announce the investigation into the deaths of Cheryl DeSombre, 48 years old, and Jay DeSombre, 65 years old, husband and wife.

    On September 22, 2014, at approximately 6:10 p.m., Roxbury Township police officers responded to 527 Wills Road located in the Landing section of Roxbury Township, New Jersey concerning a report of shots fired. Upon their arrival, they located the deceased victims within the home. The investigation did not reveal any evidence of outside intrusion into the home and there is no cause for concern to the community.

    The investigation is ongoing. Anyone with information regarding this incident is asked to contact the Major Crimes Unit of the Morris County Prosecutor’s Office at 973-285-6200 or the Roxbury Township Police Department at 973-448-2100.

    Prosecutor Knapp Announces Cause and Manner of Deaths in Fatal Shooting in Roxbury Township

    Morris County Prosecutor Fredric M. Knapp announces the cause and manner of two deaths on Wills Road in the Landing section of Roxbury Township on September 22, 2014, as well as confirming the identities of the two individuals. 

    As the result of post-mortem examinations conducted by Morris County Medical ExaminerRonald Suarez, the individuals were positively identified as Cheryl DeSombre, and her husband, Jay DeSombre.  In addition, the post-mortem examinations revealed that Cheryl DeSombre’s manner of death was listed as homicide caused by gunshot wounds inflicted upon her.  Jay DeSombre’s manner of death was listed as a suicide caused by a self-inflictedgunshot wound.

    On September 22, 2014, at approximately 6:10 p.m., Roxbury Township police officers responded to 527 Wills Road located in the Landing section of Roxbury Township, New Jersey concerning a report of shots fired. Upon their arrival, they located the deceased individuals within the home.     Male Body Found at Chatham Playground

    Morris County Prosecutor Fredric M. Knapp and Chatham Borough Police Chief Philip J. Crosson, Jr. announce that at approximately 6:37 a.m. this morning, the Chatham Borough Police Department responded to Garden Park concerning a report that a male body had been found at the playground. Patrols arrived on the scene and located the deceased victim. His identity has been determined by law enforcement but is not being released at this time. The manner of death has been determined to be suicide.

    Prosecutor Knapp thanks the Chatham Borough Police Department, the Morris County Prosecutor’s Office Major Crimes Unit and the Morris County Medical Examiner.

    There will be no further information released today.

    Two Fatalities in Boonton Township

    Morris County Prosecutor Fredric M. Knapp and Boonton Township Police Chief Paul Fortunato confirm an ongoing investigation into an incident that occurred yesterday in Boonton Township, New Jersey.  On October 1, 2014, at approximately 3:46 p.m., the Boonton Township Police Department received a 911 call requesting assistance to 434 Rockaway Valley Road, a private residence in Boonton Township. 

    A massive response was undertaken for search and rescue efforts.  Ultimately, two fatalities were confirmed.  At this time, the identities of these individuals are not being released. 

    The investigation into this incident is ongoing.  We do not anticipate any further update today.

    Update on Fatality in Chester Township

    Morris County Prosecutor Fredric M. Knapp and Chester Township Police Chief Wayne Martini announce an update and confirm an ongoing investigation into an incident that occurred in Chester Township, New Jersey. On October 12, 2014, at approximately 4:37 p.m., law enforcement was dispatched to Alstede Farms located at 1 Alstede Farms Lane, Chester New Jersey on a report of pedestrians struck by a vehicle.

    While the investigation is ongoing, the fatality of one minor child has been confirmed. Two adults also sustained injuries as a result of the incident. At this time, the identities of these individuals are not being released.

    Rockaway Twp.Man Indicted on Aggravated Manslaughter and Vehicular Homicide Charges

    Morris County Prosecutor Fredric M. Knapp, Passaic County Prosecutor Camelia M. Valdes, and Rockaway Township Police Chief Walt Ardin announce the indictment of Edward Koloski, 27 years old, of Rockaway Township, New Jersey. Koloski was indicted on October 9, 2014 after an investigation revealed that he was allegedly involved in a motor vehicle crash on February 23, 2014 on Route 46 in Rockaway Township, allegedly causing the death of Javan Robinson.  The matter has been transferred to Passaic County Superior Court for prosecution by the Morris County Prosecutor’s Office            

    Defendant was indicted on First Degree Aggravated Manslaughter; First Degree Vehicular Homicide in a School Zone; Second Degree Vehicular Homicide; Second Degree Knowingly Leaving Scene of a Motor Vehicle Accident that Resulted in Death; Third Degree Hindering Apprehension; Fourth Degree Obstructing the Administration of Law; and Fourth Degree Possession of a Radio to Intercept Emergency Communications While Committing or Attempting to Commit a Crime.

    The State was represented by Morris County Assistant Prosecutor Brian DiGiacomo in this matter.

    Defendant has presently been released on $350,000 bail.

    Bloomfield Man Found Guilty of Theft and Fraud

    Morris County Prosecutor Fredric M. Knapp and Sussex County Prosecutor Francis A. Koch announce that late yesterday a Sussex County Jury found Robert Kosch, 57 years old, of Bloomfield, New Jersey, guilty of eight counts of Theft and Fraud in relation to three properties he acquired through fraudulent means.

    The jury returned its verdict after one day of deliberations.  Robert Kosch was convicted of two counts of second degree Theft of Immovable Property, one count of third degree Theft of Immovable Property, two counts of third degree Theft of Movable Property, two counts of third degree Fraud, and one count of second degree Possession of Personal Identifying Information.  The jury acquitted Robert Kosch of three separate charges as they pertained to a fourth property.  Assistant Prosecutor Sahil Kabse represented the State in the trial which had commenced on September 9, 2014.

    Robert Kosch owned and operated Floaters, LLC, a business involved in foreclosure rescues and the purchase of real estate in various towns in Sussex County. Investigation revealed that Mr. Kosch targeted individuals who were in financial distress and had moved out of their homes.  He forged signatures on various deeds transferring ownership of properties to himself or Floaters, LLC without the consent of the homeowners.  He then proceeded to rent out the properties and collect the rental income. Robert Kosch was also found to be in possession of personal identifying information belonging to over one hundred individuals for the purposes of locating other property owners. 

    After the guilty findings, the trial judge, the Honorable Thomas J. Critchley, Jr., J.S.C. remanded the defendant to the custody of the Keogh-Dwyer Correctional Facility pending sentencing.  The defendant’s sentencing is scheduled for December 5, 2014.

    Prosecutor Knapp Announces Update in Alstede Farms Incident

    Morris County Prosecutor Fredric M. Knapp announces the cause and manner of Sunday’s fatality and injuries at Alstede Farms and confirms the identities of the adult individuals who were injured.

    As the result of a post-mortem examination conducted by Morris County Chief Medical Examiner Ronald Suarez, the cause of death of the minor child, Elizabeth Fuehring, was a blunt head trauma.The manner of death was listed as an accident.

    Sarah Fuehring and Joanna Alemany suffered serious but non-threatening injuries which they are being treated for.

    Garfield Police Officer Charged With Assault by Auto and Driving While Intoxicated

    Morris County Prosecutor Fredric M. Knapp and Chester Borough Police Chief David Jara      announce that Patrick R. Sajewicz, 22 years old, of Garfield, New Jersey has been charged with Assault by Auto; Driving While Intoxicated; Reckless Driving; and Careless Motor Vehicle Operation Causing Property Destruction.  Sajewicz is a Patrolman with the Garfield Police Department.

    On October 15, 2014, the defendant was operating a 2014 Infinity when he allegedly failed to maintain control of the vehicle and crashed into a building on Main Street in Chester.  His passenger suffered injuries as a result of the crash.  The defendant was allegedly driving while intoxicated.

    Sajewicz was arrested on October 20, 2014, following an investigation conducted by the Chester Borough Police Department and the Morris County Prosecutor’s Office.

    Former NJ Judiciary Employee Admitted into Pre-Trial Intervention Program

    Morris County Prosecutor Fredric M. Knapp announces that Joseph Robortaccio, 35 years old, of Lafayette, New Jersey, was admitted today into the Pre-Trial Intervention Program.  Robortaccio, a former New Jersey Judiciary employee who served as a Probation Officer in the Morris/Sussex Vicinage, was arrested on April 2, 2014 for possession of heroin and drug paraphernalia.

    The Morris County Prosecutor’s Office Special Enforcement Unit received information from members of the Morris County Sheriff’s Office pertaining to drug distribution activity in and around 10 Court Street, Morristown, New Jersey, specifically, the Morris County Superior Courthouse and the Administration and Records Building. As a result of the information provided by members of the Morris County Sheriff’s Office, a joint investigation was launched. The investigation resulted in the arrest of Robortaccio.

    Defendant entered a plea of not guilty and was admitted into the Pre-Trial Intervention Program in Passaic County Superior Court for a period of twelve months.  Defendant was ordered to perform seventy-five hours of community service, attend Alcoholics Anonymous/Narcotics Anonymous, in addition to continued substance abuse treatment, and be subject to random urine monitoring. Defendant was also assessed a total fine amount of $1,225 which included the $1,000 DEDR penalty and other court fees.

    Assistant Prosecutor Anthony Scibetta represented the State in this matter. 

    The Honorable Bruno Mongiardo, J.S.C. presided.

    Elizabeth Man Sentenced to 5 Years for Human Trafficking

    Morris County Prosecutor Fredric M. Knapp announces that the Honorable James M. DeMarzo, J.S.C. sentenced Wendy Archelus, a 22 year old male, of Elizabeth, New Jersey, to 5 years in State Prison in connection with human trafficking charges.

    On July 28, 2014, defendant pled guilty to Second Degree Human Trafficking.

    The defendant was initially charged as part of the Innocence Lost Initiative out of Parsippany, which was intended to locate and recover underage prostitutes.  Defendant provided services for a 17 year old female prostitute, specifically by providing her with transportation.

    Judge DeMarzo’s sentence includes a period of 3 years of parole ineligibility.  The defendant was also subject to a $15,000 mandatory fine.

    Assistant Prosecutor Christopher F. Schellhorn represented the State at the sentencing.

    Daytop New Jersey-Mendham Teacher Charged With Sexual Assault

    Morris County Prosecutor Fredric M. Knapp and Mendham Borough Police Chief Pasquale Libertino announce that Donna D. Peirce-Faley, 28 years old, of Pompton Lakes, New Jersey, has been charged with Second Degree Sexual Assault for acts involving an 18 year old.

    Defendant allegedly engaged in oral sex and sexual intercourse with an 18-year-old male while he was a court-ordered resident at Daytop New Jersey-Mendham, a drug treatment facility, and defendant was a teacher at the facility.

    Peirce-Faley was arrested on November 6, 2014 following an investigation conducted by the Mendham Borough Police Department and the Morris County Prosecutor’s Office. The investigation was led by Detective Supervisor Anne-Marie Truppo and Detective Jazmin Munoz-Felder of the Morris County Prosecutor’s Office and Detective Christopher Irons of the Mendham Borough Police Department.

    The investigation was initiated by information forwarded to law enforcement authorities by Daytop New Jersey-Mendham which fully cooperated with the investigation.

    The Honorable Catherine I. Enright, J.S.C. set bail at $150,000, no ten percent.  Defendant is to have no contact with the victim or children under 18.  The defendant was unable to post bail and was remanded to the Morris County Correctional Facility.

    Defendant Enters Guilty Plea to Dec. 29, 2012 Parsippany Carjacking

    Morris County Prosecutor Fredric M. Knapp and Parsippany Police Chief Paul Philipps announce that defendant Joseph DeFreitas, 43, entered a guilty plea before the Honorable James M. DeMarzo, J.S.C. to one count of First Degree Carjacking. 

    The defendant DeFreitas and co-defendant Marilyn Nadeau, 53, were indicted on charges of First Degree Carjacking; First Degree Kidnapping; First Degree Robbery; Second Degree Conspiracy to Commit Robbery; Third Degree Possession of a Weapon for an Unlawful Purpose; Fourth Degree Unlawful Possession of a Weapon; and Third Degree Credit Card Fraud. These charges stem from an abduction of a 71-year-old woman in Parsippany on December 29, 2012. 

    On December 29, 2012, the victim, a resident of New Hampshire, had become lost while traveling home from a visit with her family in Mt. Laurel, New Jersey.  While attempting to locate assistance for directions, the victim entered a parking lot, whereupon she was approached by DeFreitas who forced the victim into the passenger seat of her car. DeFreitas then took control of the victim’s vehicle and drove the car to an automated teller machine in Parsippany. DeFreitas forced the victim to reveal her personal identification number to complete a cash withdrawal. It is alleged that the victim complied and after completing the transaction, the victim was driven, with Nadeau following, to an industrial building parking lot on Woodhollow Road in Parsippany. Nadeau parked the car, at which time DeFreitas and Nadeau allegedly forced the victim into the trunk of her own car.  The victim freed herself from the trunk of her vehicle and called for help.

    Under the terms of the plea agreement, the State will recommend a 25 year New Jersey State Prison sentence.  The defendant will have to serve 85% of that sentence before becoming eligible for parole under the No Early Release Act.  All remaining charges will be dismissed.  

    Sentencing is scheduling for December 19, 2014.

    Charges against the co-defendant, Marilyn Nadeau, remain open and are scheduled for December 2, 2014.  These criminal charges are only accusations.  She is presumed innocent until proven guilty in a court of law.

    This case is being prosecuted by Supervising Assistant Prosecutor Peter Foy and Assistant Prosecutor Brian DiGiacomo.
